Terms & Conditions

These Terms govern your use of PonyMail (the “Service”), a free beta web email client operated by Ollie Pips Studio (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What PonyMail is

PonyMail is an independent web interface for Gmail. It is not affiliated with, endorsed by, or sponsored by Google LLC. Gmail and Google are trademarks of their respective owners. You need your own Google account, and your use of Gmail remains subject to Google’s own terms.

2. Free, beta, no warranty — you assume all risk

The Service is provided free of charge, in beta, “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

You assume all risk arising from your use of the Service, including message delivery failures or delays, mail that is mislabelled, archived, snoozed, moved to spam, or deleted, data loss or corruption, and interruption of access. Always keep an independent means of accessing your mailbox. Do not rely on the Service for time-critical, safety-critical, legal, medical, or financial communications.

3. Limitation of liability

To the maximum extent permitted by law, Ollie Pips Studio and its contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or in connection with the Service. Our total aggregate liability for all claims will not exceed USD 50. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud, death, or personal injury caused by negligence.

4. Acceptable use

You agree not to use the Service to:

  • send spam, bulk unsolicited mail, phishing, malware, or unlawful content;
  • access a mailbox you are not authorised to access;
  • impersonate any person or misrepresent your affiliation;
  • probe, scrape, overload, reverse engineer, or otherwise interfere with the Service or the Gmail APIs it relies on;
  • violate any applicable law, export control, or third-party right.

We may suspend or terminate access at any time, with or without notice, including for suspected misuse or to protect the Service.

5. Your content

Your email content belongs to you. We claim no ownership of it. We access it only to operate the Service for you, as described in the Privacy Policy. We do not sell it, and we do not use it to train advertising or AI models.

6. Availability and changes

The Service is experimental. We may change, suspend, or discontinue any part of it — or the whole of it — at any time without liability. We may update these Terms; material changes will be reflected by the “last updated” date above, and continued use after that date constitutes acceptance.

7. Termination

You may stop using the Service at any time by disconnecting your Google account, which revokes our access and deletes the data we hold about you. See the Privacy Policy for how to export or erase your data.

8. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. The state and federal courts located in California have exclusive jurisdiction, except that consumers resident in the EEA, the UK, or elsewhere retain the benefit of any mandatory protections and the right to bring proceedings in their place of residence.
